2. United States Consumer Notice

Nothing in this Notice or our Terms of Service is intended to waive, restrict, or exclude a consumer right or remedy that cannot lawfully be waived under applicable U.S. federal or state law.

Certain rights, disclosures, warranties, cancellation rights, privacy choices, and dispute-resolution requirements may vary by state. Where applicable law provides greater protection than our general policies, the mandatory legal requirement will control.

3. Product and Regulatory Information

Use each Vinabot product only in accordance with its user manual, safety instructions, power requirements, warnings, and intended use. Product-specific regulatory markings, identifiers, and notices, where applicable, may appear on the product, packaging, electronic label, user manual, or accompanying documentation.

Where a product’s labeling or documentation states that it is subject to FCC Part 15, operation is subject to the following two conditions:

  1. The device may not cause harmful interference.
  2. The device must accept any interference received, including interference that may cause undesired operation.

For device-specific regulatory information or available compliance documentation, contact support@vinabot.ai. This webpage does not replace any notice supplied with a particular product.

4. AI and Digital Character Disclosure

Vinabot offers automated and AI-enabled functions that may include speech recognition, conversational AI, voice synthesis or cloning, photo animation, digital character creation, and image, video, audio, or text generation.

  • AI characters and generated outputs may be fictional, synthetic, or automatically generated.
  • AI responses may be inaccurate, incomplete, outdated, unexpected, or unsuitable for a particular purpose.
  • AI-generated content should be reviewed before it is relied upon, published, distributed, or used commercially.
  • AI conversations do not represent statements made by a real person unless that person has actually provided or approved the statement.

Vinabot AI features are not a substitute for professional medical, legal, financial, emergency, safety, or other qualified advice. Weather, news, and other third-party information may be delayed or inaccurate and should not be used as the sole basis for safety-critical decisions.

5. Voice, Likeness, and Content Rights

You may upload or process a person’s photograph, video, voice, likeness, or other personal content only when you have the rights, permissions, licenses, and consents required by applicable law.

You must not use Vinabot to:

  • impersonate another person without authorization;
  • create a false statement, endorsement, or representation attributed to another person;
  • infringe copyright, trademark, privacy, publicity, personality, or data-protection rights;
  • engage in fraud, deception, harassment, exploitation, or other unlawful conduct.

Additional restrictions are described in our Terms of Service.

6. Privacy and U.S. State Privacy Rights

Our Privacy Policy explains how we collect, use, disclose, process, store, and protect Personal Information and App User Content.

Depending on applicable law and your state of residence, you may have rights to request access, correction, deletion, portability, or information about certain processing, and to opt out of certain sales, sharing, targeted advertising, or profiling. You may also have the right not to receive discriminatory treatment for exercising an applicable privacy right.

To submit a privacy request, contact support@vinabot.ai. We may request reasonable information to verify your identity and will process applicable requests in accordance with law.

7. Children’s Privacy

The general Vinabot Services are not intended to knowingly collect Personal Information directly from children under 13 without appropriate parental or legal-guardian involvement.

Children under 13 should not independently create an account, upload photos or videos, provide voice recordings, use voice-cloning functions, submit AI conversations, or provide other Personal Information unless Vinabot offers a specific feature with the notices, consent, and controls required by applicable law. Please review the Children’s Privacy section of our Privacy Policy.

8. Copyright and Intellectual-Property Notices

Vinabot respects intellectual-property rights. If you believe content available through the Services infringes your copyright or other intellectual-property rights, send a written notice to support@vinabot.ai containing sufficient information for us to identify and evaluate the claim.

A copyright notice should include, where applicable:

  • identification of the copyrighted work;
  • identification and location of the allegedly infringing material;
  • your contact information;
  • a statement of your good-faith belief that the use is not authorized;
  • a statement that the information in the notice is accurate and that you are authorized to act;
  • your physical or electronic signature.

This contact method does not represent that Vinabot has completed any particular U.S. Copyright Office designation. Any formal DMCA agent information, if applicable, will be separately published and maintained as required by law.

9. Reviews, Endorsements, and Creator Disclosures

Reviews and testimonials should reflect genuine experiences and must not be false or misleading. A creator, affiliate, reviewer, or other endorser who receives payment, commission, free products, discounts, or another material benefit should clearly and conspicuously disclose that relationship where required by law or platform rules.

Vinabot does not require a reviewer to express a positive opinion as a condition of receiving support, compensation, or a product, and incentives must not be conditioned on a particular star rating or sentiment.

10. Accessibility

Vinabot seeks to make its website and digital services usable by a broad audience, including people with disabilities. We continue to review and improve accessibility as our products and services develop.

If you experience difficulty accessing information, completing a purchase, or using a feature, contact us through our Contact Us page and describe the content or function you need. We will make reasonable efforts to provide assistance or an alternative method where appropriate.

11. Third-Party Services and Information

Some Vinabot functions depend on independent providers for AI processing, cloud hosting, payments, analytics, authentication, logistics, weather data, and other services. Third-party terms and privacy policies may apply.

Availability, accuracy, and performance may be affected by third-party systems or events outside Vinabot’s reasonable control. References or links to third-party services do not constitute a guarantee or endorsement unless expressly stated.

12. Governing Law and Arbitration

These Terms and any separate agreements through which we provide the Services shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region of the People's Republic of China (“Hong Kong”), without regard to conflict-of-law principles.

Any dispute, controversy, difference, or claim arising out of or relating to these Terms, the Services, or any transaction with Vinabot, including any question regarding the existence, validity, interpretation, performance, breach, or termination of these Terms, shall, to the extent permitted by applicable law, be referred to and finally resolved by arbitration seated in Hong Kong.

The arbitration will be conducted in English unless otherwise agreed by the parties.

Nothing in this Section limits any mandatory consumer right or remedy that cannot lawfully be waived or requires a consumer to arbitrate where such requirement would be unenforceable under applicable law.

13. Changes to This Notice

We may update this Notice to reflect changes to our products, AI functionality, business practices, third-party providers, regulatory requirements, or applicable law. The revised version will be posted with an updated “Last Updated” date. Additional notice or consent will be provided where required by law.
