This Privacy Policy explains how we collect, use, disclose, process, store, and protect your information when you:

  • visit or purchase from the Vinabot website or online store;
  • create or use a Vinabot account;
  • use the Vinabot App or a connected Vinabot device;
  • upload photos, videos, audio, text, or other content;
  • use AI-powered features such as digital character generation, AI voice interaction, voice cloning, image or video generation, or AI conversations;
  • contact us or otherwise interact with our products and services.

Our websites, applications, connected devices, AI features, subscriptions, customer support, and related services are collectively referred to as the “Services.”

For purposes of applicable data-protection laws, LAIPIC AI TECHNOLOGY COMPANY LIMITED is the controller of Personal Information processed under this Privacy Policy, except where a third-party service provider acts as an independent controller.

SECTION 1 – INFORMATION WE COLLECT

The information we collect depends on how you use the Services.

We do not receive your password for the third-party account.

Complete payment-card information is generally processed by Shopify or the applicable payment provider rather than directly by Vinabot.

1.3 App User Content

When you use the Vinabot App or connected Vinabot devices, you may voluntarily provide or create content including:

  • photographs;
  • videos;
  • audio or voice recordings;
  • text prompts or instructions;
  • AI conversation content;
  • content used to create digital characters;
  • AI-generated images, video, speech, or other outputs.

We refer to this information collectively as “App User Content.”

1.4 Device and Technical Information

When you use the Vinabot App or connected devices, we may collect technical information necessary to operate, maintain, and support the Services, including:

  • device type or model;
  • device identifier;
  • serial number where applicable;
  • operating-system or firmware version;
  • app version;
  • network and connectivity information;
  • IP address;
  • diagnostic information;
  • crash or error information;
  • application or device logs.

1.5 Website and Usage Information

When you visit our website or use our Services, we and our service providers may automatically collect information such as:

  • provide text-to-speech functionality;
  • provide voice synthesis;
  • provide voice-cloning functionality.

2.4 Video

  • synchronize video content;
  • display or play video on a Vinabot device;
  • provide video-related functions requested by you.

2.5 Text and AI Conversations

Text, prompts, or conversation content may be used to:

  • provide AI conversations;
  • interpret user instructions;
  • generate requested content;
  • maintain the context necessary to provide conversational or generative AI functions.

2.6 Device Information

Device and technical information may be used to:

  • identify and manage connected devices;
  • support device binding and operation;
  • diagnose technical issues;

  • maintain Service security and reliability.

SECTION 3 – AI PROCESSING AND THIRD-PARTY AI SERVICES

Certain Vinabot AI functions rely on third-party AI and computing service providers.

Depending on the feature you use, limited App User Content may be transmitted to a third-party provider solely to perform the requested AI processing.

Our current algorithm-side integration includes the OpenAI SDK. We may also use other third-party AI or computing services as necessary to support speech, voice, image, video, and related AI functions.

Speech Recognition

Audio or voice information may be processed by a third-party speech-recognition service to convert speech into text.

Voice and Speech Generation

Voice and text information may be processed to provide:

  • text-to-speech;
  • voice synthesis;
  • voice cloning;
  • related voice functions.

Image and Video Generation

Images and text instructions may be processed to provide:

  • image generation;
  • image processing;
  • video generation;
  • related visual AI functions.

Conversational AI

Text submitted by users may be processed through AI services, including OpenAI technology, to generate conversational responses.

We seek to limit the information transmitted to third-party AI providers to what is reasonably necessary to perform the relevant feature.

The providers and technologies used by Vinabot may change as we update or improve the Services.

SECTION 4 – THIRD-PARTY AI DATA RETENTION AND MODEL TRAINING

4.1 AI Provider Retention

Based on the service configurations currently used by Vinabot, third-party AI providers processing App User Content on our behalf do not retain user input or output after completing the processing necessary to provide the relevant Vinabot function.

If this arrangement materially changes, we will update this Privacy Policy as appropriate.

4.2 AI Model Training

Vinabot does not use private App User Content, including private photos, audio, voice recordings, videos, AI conversations, or similar private user content, to train or optimize general-purpose AI models.

Based on our current service configurations, third-party AI providers processing App User Content on our behalf also do not use that content to train or optimize their general-purpose AI models.

We may use aggregated, de-identified, diagnostic, technical, synthetic, or voluntarily submitted feedback information to operate and improve the Services where such information does not reasonably identify an individual.

If we propose to use identifiable private App User Content for a materially different model-training purpose in the future, we will provide appropriate notice and obtain consent where required by applicable law.

SECTION 5 – OTHER THIRD-PARTY SERVICE PROVIDERS

We use third-party service providers and software development kits (“SDKs”) to support the operation of the Vinabot App and related Services.

Depending on the functions you use and the configuration of the App, these providers may support functions such as:

  • app infrastructure and technical services;
  • analytics and attribution;
  • account authentication and login;
  • payment and subscription processing;
  • customer support;
  • technical diagnostics and network monitoring;
  • security and fraud prevention;
  • other functions necessary to operate and maintain the Services.

These services may process limited information such as:

  • device information;
  • account information;
  • app usage information;
  • transaction or subscription information;
  • diagnostic and technical information;

where reasonably necessary to provide the relevant function.

We seek to provide third-party service providers only with the information reasonably necessary to perform their functions.

Certain third-party providers may process information under their own privacy policies and legal obligations.

Some third-party SDKs may be included in a particular version of the Vinabot App without being actively used for a user-facing function. Where an SDK is not activated or used by the relevant Service, Vinabot does not intentionally use it to process Personal Information for that function.

SECTION 6 – SHOPIFY AND PAYMENT PROCESSING

Our online store is hosted on Shopify.

Shopify may provide services including:

  • storefront hosting;
  • checkout;
  • customer accounts;
  • transaction management;
  • fraud prevention;
  • analytics;
  • other e-commerce functions.

Information collected through the Vinabot website or online store may therefore be processed by Shopify and its service providers.

Payment Information

Payments may be processed by Shopify Payments or another payment provider.

Vinabot generally does not directly receive or store your complete payment-card number.

Payment providers may process and retain information according to:

  • their privacy policies;
  • payment-security requirements;
  • fraud-prevention requirements;
  • financial regulations;
  • legal record-retention obligations.

SECTION 7 – STORAGE AND INTERNATIONAL PROCESSING OF APP USER CONTENT

7.1 App User Content Stored in the United States

App User Content retained by Vinabot on an ongoing basis is persistently stored in the United States.

Our current persistent storage infrastructure for App User Content is located in the U.S. East region.

Depending on the Vinabot functions you use, stored App User Content may include:

  • photos;
  • videos;
  • audio or voice content;
  • text submitted for AI functions;
  • AI conversation content;
  • digital character-related information;
  • AI-generated content.

This U.S. storage commitment applies specifically to App User Content retained by Vinabot.

7.2 Temporary Processing in Other Locations

To provide certain AI and technical functions, App User Content may be transmitted to or temporarily processed by computing infrastructure located outside the United States.

This may occur for functions including:

  • speech recognition;
  • voice synthesis;
  • voice cloning;
  • image processing;
  • image generation;
  • video generation;
  • conversational AI;
  • network transmission or technical processing.

Such processing is intended to be limited to performing the relevant function.

Based on our current service arrangements, third-party AI providers do not retain user inputs or outputs after completing the relevant processing.

7.3 Website and E-Commerce Information

The U.S. storage commitment described above applies specifically to App User Content.

It does not mean that all information collected through the Vinabot website, Shopify store, payment services, shipping providers, analytics providers, or other third-party services is stored exclusively in the United States.

For example, information such as:

  • website browsing data;
  • cookies;
  • customer contact information;
  • billing and shipping details;
  • order information;
  • payment records;
  • shipping and logistics information;
  • analytics information;

may be processed or stored according to the infrastructure and legal obligations of the applicable third-party provider.

7.4 International Transfers

Where Personal Information is transferred across national borders, we use safeguards as required by applicable law.

Depending on the circumstances, these safeguards may include:

  • contractual data-protection obligations;
  • confidentiality requirements;
  • security measures;
  • access controls;
  • data-processing agreements;
  • legally recognized international data-transfer mechanisms.

Based on our current service arrangements, third-party AI providers do not retain user input or output after completing the relevant processing.

  • warranty claims;

  • tax obligations;
  • fraud prevention;
  • legal compliance.

Diagnostic and Technical Information

Vinabot accounts should be created and managed by a person legally capable of entering into the relevant agreement or providing any required consent.

Our general Services are not intended to knowingly collect Personal Information directly from children under the age of 13 without appropriate parental or legal-guardian involvement.

Unless Vinabot provides a specific child-directed feature with appropriate parental notice and consent procedures, children under 13 should not independently:

  • create a Vinabot account;
  • upload photos or videos;
  • provide voice recordings;
  • use voice-cloning functions;
  • submit AI conversations;
  • provide other Personal Information.

Where applicable local law establishes a higher age requirement for independent consent, that higher requirement will apply.

SECTION 13 – CONTENT RELATING TO OTHER PEOPLE

You are responsible for ensuring that you have the rights, permissions, or consent necessary to upload or process content relating to another person.

  • face or likeness;
  • voice;
  • video;
  • Personal Information.

You must not use Vinabot to clone, imitate, animate, or generate content using another person's voice, likeness, or other protected information without the authorization required by applicable law.

SECTION 14 – THIRD-PARTY WEBSITES AND SERVICES

The Services may contain links to or integrations with independent third-party websites, applications, or services.

These may include:

  • payment services;
  • logistics providers;
  • authentication services;
  • app stores;
  • social-media services;
  • other websites or platforms.

When you use an independent third-party service, its own terms and privacy policy may apply.

Vinabot does not control the privacy or security practices of independent third parties.

SECTION 15 – AUTOMATED PROCESSING AND AI OUTPUTS

Vinabot uses automated systems and artificial intelligence to provide functions that may include:

  • voice cloning;
  • digital character generation;
  • AI conversations;

  • related generative AI functions.

AI-generated outputs may be produced automatically based on information or instructions submitted by you.

AI-generated results may not always be accurate, complete, unique, or appropriate.

Unless separately disclosed, Vinabot does not use these automated features to make decisions that produce legal or similarly significant effects concerning matters such as employment, credit, insurance, housing, education admission, or access to essential services.

SECTION 16 – SALE OR SHARING OF PERSONAL INFORMATION

Vinabot does not sell Personal Information for monetary consideration.

Depending on the laws applicable in your jurisdiction, certain uses of advertising, analytics, or marketing technologies may be considered “sharing,” “targeted advertising,” or a “sale” even where no monetary payment is involved.

Where required by applicable law, we will provide an appropriate method for exercising applicable opt-out rights.
